Subject: Night Mining Work April 15-16, 2008

Dear Mr. Black and Mr. Ley:

Attached is a copy of the email I received this morning from Mr. Bruce Lenio of 190 Pavola Way in the Venetian Golf & River Club complaining about all night mining operations last night.

Did either of you authorize mining operations to be conducted last night and if so, for whom and upon what circumstances? If you did not authorize them, we would appreciate your investigating them.

In any event, it is clear based on Mr. Lenios complaint that in violation of Section 5.3.5 of the Sarasota County Ordinance, the noise was discernable outside of the property lines and into the Venetian. Please enforce this Ordinance.

The nightmare is that Mr. Lenio may not be able live with this nuisance and because of it he may not be able to sell his home or he may have to sell it for a diminished value.

The City of Venice via its annexation and approval of the Venetian adjacent to the Mining Operation may have adversely affected the ability of the Mining Operators to refrain from having their pre-existing mining operations within a half mile of residential properties, but that should not have relieved the Mining Operators from the provision of Section 5.3.5. that prohibits noise and dust that is discernable outside of their property lines since there has been no change in their property lines.

Thought you would like to know that last night was the worse night for mining noise that I have experience since closing on our property in mid 2003. At midnight and beyond, the sounds of heavy machinery with its "beep beep beep" resonated through the night, combined with a periodic and tremendously loud "bang bang bang", with what sounded like steel banging on steel.

When researching the Venetian as a potential place to live, I specifically asked the Venetian Community Representative (sales person) when the mining operations would be terminated. His name was Ron Moxin and he told me "within 5 years". This conversation took place in August of 2002. Of course, he also told me that for real estate tax purposes, the property was actually located in Nokomis, not Venice. You can imagine my surprise when I received my first tax bill. My experience with WCI has been one lie after another.

You may use the above comments any way you see fit. I will not be showing up at any city council meeting to share my comments/concerns. As soon as the real estate market regains some life, I'm selling and leaving this bad dream behind.
